Getting to the trial calendar
After the note of issue, the case waits for a trial part. Summary judgment motions are often filed in this window, and the deadline to make them is strictly enforced. Pre-trial conferences narrow the issues and produce a final settlement push, since courts prefer to try only what genuinely needs trying.
Jury or bench
A jury must be demanded in the manner and time the rules require, or the right is waived. Jury selection in Brooklyn draws from a diverse pool and typically takes a day or more. Bench trials are faster and better suited to document-driven commercial disputes; juries can be more receptive in cases with strong human facts.
Presenting evidence
Every document needs a foundation and a witness who can authenticate it. Business records need the records-custodian foundation. Hearsay excluded at trial cannot be cured by argument. Prepare a clean exhibit binder, pre-mark exhibits, and try to stipulate to authenticity of undisputed documents so trial time is spent on what is actually contested.
After the verdict
A verdict is followed by entry of judgment, which triggers post-trial motions and the appeal clock. Interest generally runs from the date set by law or by the court. If you won, plan enforcement immediately; if you lost, calendar the deadline to appeal and to seek any stay before enforcement begins.
